In these conditions of sale:

The following conditions may only be modified by variation in writing signed on behalf of the Company by the Managing Director.

1. The Company means Mobile Gritting Services Ltd T/A Icecracker
2. Correspondence address: Unit 1B Meadowside Complex, Meadowside Street, Renfrew PA4 8LF.
3. The customer means any person’s contracting with the company for the supply of goods and services
4. Delivery of our goods means delivery by our own transport or sub-contractor employed directly or indirectly.

The following conditions/wording will have the aforementioned meanings:

Buyer- The purchaser of the goods or services referred to in these conditions as” You” or “Your”.

Contract: A legally binding contract.

Seller: Icecracker a trading name of Mobile Gritting Services Ltd registered in Scotland No: 378279 Vat Registered No: 119 4294 07 referred to in these conditions as “We” “Our” or “Us”.

Services: The services described in the purchase order.

Confirmation: a written confirmation in the form of an electronic message acknowledging your order,

Sites: Our website: either www.icecracker.co.uk or www.mobilegrittingservices.co.uk

Working week: Monday – Friday excluding Public holidays applicable in Scotland.

Supply:

Contracts for the supply of goods or services to retail or domestic customers are governed by the Sale of goods act 1979 (as amended) and supplied in compliance with, the consumer protection (distance selling) regulation 2000 (as amended) by S1689 2005, any customer contacting in the course of their business are excluded from consumer protection legislation and are contacting with the company on a Business to Business basis.

Online orders are accepted upon payment by the PayPal method by Credit/Debit card at the time of ordering, or by telephone call to our office where payments can be made, Prices quoted are not inclusive of vat or delivery, unless otherwise stated,

The customer is made aware that exact specifications in regards to our white marine rock salt may Have slight variations as it is a natural product, we cannot guarantee the colour or exact grain size as our website is reproducible,

All products collected or delivered will be the responsibility of the customer, after collection or delivery, we will not be liable for any loss, damage or deterioration of the goods supplied.

Order amendments must be notified before orders are due to be dispatched from our warehouse/ Yard, amendments should be confirmed by telephone or e-mail,

The company reserve the right to cancel any order placed, any such orders will be refunded in full ASAP, If we decide to cancel an order we will notify the purchaser direct by e-mail to confirm,

Customer complaints should be made in writing to our correspondence address within 48hrs of collection or delivery, any product supplied by us which is deemed to be faulty must be returned to our correspondence address, where a refund for the goods will be processed.

Delivery:

The company will endeavour to deliver on the agreed time and date, but when this is not possible for whatever reason, the company will not be held liable for delays or damages,

Delivery is conditional and is dependable on number of factors i.e. road conditions, traffic flow, Road closures to name a few.

We will not be held liable for any damage to goods whilst being delivered or unloaded.

Deliveries are normally made by LGV Vehicles with a tail-lift off loading facility, it is the customers Responsibility to ensure that access is made available in order to receive the delivery, All deliveries must be checked and signed for by the receiving customer or their representative.

Cancellation / Returns:

The customer has the right to cancel an order, any cancellation must be notified to us within 3 days of order confirmation, Cancellations must be made by e-mail to Info@icecracker.co.uk / info@mobilegrittingservices.co.uk followed by a telephone call, Returns must be sent to our correspondence address.

This does not affect your statutory rights.

Company Premises:

The customer will comply with all matters concerning Health and Safety whilst on our site. MGS Ltd accepts no responsibility for Injury or damage caused to persons, vehicles or equipment Whilst on company premises, the customer will be responsible for the security and for the Insurance of themselves, their vehicles and their equipment, Once our products are supplied/ loaded by our staff and have left our premises it then becomes the customer’s responsibility.

Trademarks:

Product and company names mentioned on this web site may be trademarks or registered trademarks of their respected owners.
